The US Securities and Exchange Commission (SEC) is preparing to advance new regulations for the digital asset sector after Congress failed to enact a comprehensive law to govern cryptocurrency.

SEC moves forward with proposed crypto framework

On Tuesday, the SEC will end the public comment phase for its ‘Regulation Crypto Assets’ proposal. This rule set was introduced in August to establish what the SEC described as a “clear and fit-for-purpose framework for certain investment contracts involving crypto assets.”

Over a designated 60-day period, the SEC received roughly 140 public comments from organizations, industry representatives, and individual stakeholders. Feedback centered on regulatory aspects such as the safe harbor provision, which could allow token issuers to avoid classification as “investment contracts,” and possible exemptions for companies making token offerings up to specified amounts.

Industry and investor perspectives

Prominent figures in the financial sector have weighed in on the SEC’s initiative. Anthony Scaramucci, founder of SkyBridge Capital, stated his support for the proposed crypto rules. He noted the regulations address the “organic adoption” of digital assets and position the SEC to fulfill its intended regulatory function. Scaramucci did not comment on Congress’s lack of action regarding the Digital Asset Market Clarity (CLARITY) Act.

Six comments were submitted anonymously during the period. Some responses expressed support for the SEC’s regulatory approach, while others encouraged further stakeholder engagement and clarity on implementation.

Comments highlighted that the new regulations would create more transparency in the digital asset market and provide clearer guidance for industry participants, but also raised concerns over potential uncertainty if changes are introduced without congressional backing.

Regulatory outlook and challenges

While the majority of the feedback welcomed SEC efforts to clarify the regulatory landscape for crypto, some legal observers have warned that rules adopted exclusively by the Commission could be susceptible to reversal, unlike statutory measures passed by Congress.

The SEC, together with the Commodity Futures Trading Commission (CFTC), continues to share joint oversight of different facets of the crypto market. However, both agencies reportedly have ongoing gaps in senior leadership, which could impact the pace and effectiveness of rulemaking.

In related developments, the House Financial Services Committee has also been actively reviewing the issue. The committee’s chair previously remarked that regulatory agency efforts to date have “fallen short” of the intended clarity legislators sought to deliver through the CLARITY Act.

Mini dictionary: Digital Asset Market Clarity (CLARITY) Act, a proposed US legislative initiative designed to clarify which digital assets qualify as securities or commodities and assign regulatory responsibilities among federal agencies.

Market participants remain watchful as the SEC proceeds with the next steps following the close of public consultation, with expectations for further regulatory adjustments or new rule announcements in the coming months.
